Quest for justice for attempted murder victim Anh Peng Taylor continues

Judge Eric Fleming to defense counsel:  It’s state prison or trial 

April 16, 2024, San Francisco, CA – Today, Judge Eric Fleming ruled in agreement with a previous ruling by Judge Jeffrey Ross that Intensive Supervision Court and probation is not appropriate for defendant Daniel Cauich for the attempted murder of 94-year old victim Anh Peng Taylor.

Judge Fleming decisively rejected the defense attorney’s effort to return the case to Judge Kay Tsenin, who had earlier unlawfully granted probation to the defendant after he pled guilty to attempted murder and elder abuse, and the District Attorney had offered a 12-year prison sentence for the plea. 

Judge Fleming is leaving the defendant with two choices:  Go to state prison or withdraw his guilty plea and stand trial.  

Frank Noto, President of Stop Crime Action says, “As a victims’ rights organization, we recognize the significant amount of discretion judges have in case outcomes. But the public needs to know that violent felons won’t be released to assault seniors again, but will be remanded to locked mental health facilities or incarcerated until there is assurance that they won’t attack again. We’re glad to see some judges restore our faith in the justice system, and we will look forward to seeing fair and just closure to this case.”

The next hearing to set sentencing will be on April 23, 2024.

History of case:

In June 2021, Anh “Peng” Taylor, age 94 years old at the time, was violently stabbed by Daniel Cauich in Lower Nob Hill of San Francisco. Cauich pleaded guilty to the charges of attempted murder, elder abuse and assault.

San Francisco District Attorney Brooke Jenkins made a 12-year state prison plea offer to Daniel Cauich, who the D.A. believes is a danger to the community at-large. 

On March 15, 2024, San Francisco Judge Kay Tsenin undercut the D.A. 's offer by offering Cauich a sentence to probation through the Intensive Supervision Court and release upon sentencing. This was an open plea to the court over the DA’s staunch objection.

On March 22, 2024, a demonstration attended by over 100 seniors and community members and citywide advocacy organizations protested Judge Kay Tsenin’s sentencing on the steps of the Hall of Justice demanding the courts end the release of violent repeat offenders and  restore public safety on the streets of San Francisco. 

The sponsors of that rally on March 22 were Association for the Advancement of Asians (AAA),  Asian Pacific American Community Center (APACC), Dear Community, Delta Chinatown Initiative, Positive Directions Equals Change, and Stop Crime SF.
